Maintaining a backup
Our Website does not contain any content that we are responsible for. In the event that any Content is lost, we will not be responsible. Liability limitations
To the greatest extent permitted by law, Quantumsoft Innovation, its affiliates, officers, directors, employees, agents, suppliers, or licensors will not be liable to anyone for any indirect, incidental, special, punitive, cover, or consequential damages (including, without limitation, lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity), however caused, under any theory of liability.
If Quantumsoft Innovation, its affiliates, officers, employees, agents, suppliers, and licensors are found to be collectively liable for the services, the liability shall be limited to the greater of one dollar or the amount of any cash payments made by you to Quantumsoft Innovation during the preceding calendar month prior to the first event or occurrence giving rise to such liability. Limitations and exclusions also apply if this remedy does not fully restore any losses you may have incurred or accomplish its intended result.
Assumption of responsibility
You consent to defend, indemnify, and remain harmless to Quantumsoft Innovation, its affiliates, directors, officers, employees, and agents from and against any liabilities, losses, damages, or expenses incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them due to or in connection with your Content, your use of the Website or Services, or any willful misconduct on your part.
Ability to segregate
The rights and restrictions set forth in this Agreement are applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary to prevent this Agreement from being illegal, invalid, or unenforceable. If a court of competent jurisdiction rules that any provision of this Agreement is illegal, invalid, or unenforceable, the parties intend that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
Resolving disputes
This Agreement shall be governed by and construed in accordance with the substantive and procedural laws of India, without regard to its principles of conflicts of law or choice of law, and, to the extent applicable, Indian laws. You hereby submit to the personal jurisdiction of the state and federal courts located in India as the sole jurisdiction and venue for actions pertaining to the subject matter of this agreement. You hereby relinquish any right to a jury trial in any action arising out of or connected to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement.
Amendments and changes
The Website or Services may be modified at any time by posting a revised version of this Agreement on the Website. The updated date will be updated at the bottom of this page once we have done so. If you continue to use the Website after such changes have been made, you will be deemed to have consented to them.
